    THIS MORNING AFTER HAVEN SPOKEN TO YOU, I SPOKE TO COMM.LAVEIST.
    COMM.LAVEIST TOLD ME HE WILL HAVE RAPHY BOASMAN(LABOUR DEPT.) CALL ME. I NEVER RECEIVED THAT CALL. YESTERDAY AFTERNOON I GAVE MR BOASMAN THE DOCUMENTS, CALLED HIM SEVERAL TIMES IN THE AFTERNOON AND MORNING, NO RESPONSE.
     
    THE PARLIAMENT SHOULD TRY SEND US THESE COMPLICATED DOCUMENTS AT LEAST 3 DAYS EARLIER, IF POSSIBLE. NONETHELES, THESE ARE MY NOTES, QUESTIONS AND OBSERVATIONS
     
     
    DISCUSSION PIECE:
    -PARLIAMENT WOULD LIKE TO HEREBY FOCUS ON THE LEGISLATION WITH REGARD TO THE DECETRALISATION OF THE LABOURLAWS AND THE FEDERAL LABOURDEPARTMENT.
     
    -THIS HAS BEEN DIVIDED IN TWO:
      1-AMENDING OF THE ERNA(ISLAND REGULATION)
      2-CONCEPT FEDERAL ORDINANCE WITH REGARD TO AMENDING OF THE LABOUR LAWS.
     
    -THIS ENTAILS 6 PIECES OF LEGISLATION:
      1-THE LABOUR LAWS.
      2-FEDERAL ORDINANCE ON LABOUR CONFLICTS
      3-FEDERAL ORDINANCE ON CLA(COLLECTIVE LABOUR AGREEMENTS)
      4-REGULATION ON VACATION.
      5-FEDERAL ORDINANCE ON THE STIMULATION OF EMPLOYMENT OF THE UNEMPLOYED YOUTH.
      6-FEDERAL ORDINANCE ON MINIMUM WAGE.
     
    OBJECTIVE FEDERAL GOVERMENT INTENDS TO TRANSFER AS MUCH AUTHORITY AS POSSIBLE TO THE ISLAND TERRITORIES.
     
    IN THE FOLLOWING EMAIL, I WILL PROPOSE SOME MORE OBSERVATIONS AND QUESTIONS.

    -AFTER( GETTING OUR STATUS) AND  DECENTRALISING THE FEDERAL LABOURDEPARTMENT, AND OTHER DEPARTMENTS FOR THAT MATTER. HOW WILL ST.MAARTEN DEAL WITH THE VARIOUS INTER-
    NATIONAL TREATIES LIKE e.g. OUR AGREEMENT(S) WITH THE I.L.O
     
    -TIJDSTIP OVERDRACHT. WHEN IS THE FED.GOVT. PLANNING TO ULTIMATELY TRANSFER THIS DEPT.
     
    -AFTER DECETRALISATION SOME FORM OF CONTROL WILL BE PUT IN PLACE. HOW WAS THIS DONE WITH ARUBA? FOR HOW LONG WILL THIS INSTITUTION BE PUT IN PLACE?Z.G. CENTRALE AUTORITEIT.
     
    – IT IS SAID THAT:”LAND NED.ANT.BLIJT TOEZICHT EN CONTROLE UITOEFENEN. IS THIS ONLY FOR LABOUR?WHY IS THIS NECESSARY?
    -THE FED.GOVT. WILL CONTINUE TO EXIST?  ISNT IT THE OBJECTIVE THAT ALL AUTHORITY WILL BE ULTIMATELY TRANSFERED TO “COUNTRY SXM”. PLEASE EXPLANE AND ANALYSE.
     
    -WHEN WILL THE EMPLOYEES BE HEARD? WILL THEY GET A CHOICE? HOW IS THE SITUATION WITH REGARDS TO THEIR PENSION AND OTHER RIGHTS.
     
    -IT IS SAID:”ONLY BONAIRE IS READY TO ASSUME THE RESPOSIBILITY”. BASED ON WHAT WAS THIS DECIDED? BONAIRE IS GOING DIRECT UNDER HOLLAND. I DONT SEE THE RELEVANCE OF THE REMARK.
     
    -VERDRACHTSVERPLICHTINGEN. WHICH LAWS DO WE HAVE TO CHANGE FOR SXM TO GET THIS AUTHORITY.
     
    -WHEN CAN WE START HIRING/TRAINING PERSONEL.FEDERAL MEDIATOR ETC.
     
    -THE  2 FOLLOWING ORDINANCES HAVE NOT BEEN ADRESSED YET: 1-FEDERAL ORDINANCE ON FREE LEGAL AID.2-FEDERAL ORDINANCE ON THE TERMINATION OF LABOUR AGREEMENTS.
     
    -THIS PROCES HAS TO MOVE ASAP IN ORDER FOR US TO APPOINT AMONG OTHERS, ONE OR MORE FEDERAL MEDIATORS.

    Dear All,

    This article is the exact thing that is wrong with our organization. How can this article be placed in the newspapers when the issue at hand has not been handled by the organization and decided upon by the Executive Council. I have yet to see a professional advice from the organization (including P&O ) on this matter. After reading the article there is even mention of someone within the department being identified as a replacement for the Interim Head. How was this arrived at? Did we advertise the apparent vacancy? Were the procedures followed? Are we going to allow the departments to be run like this? Where does the interference into the professional running of the organization begin and especially end?

    I also interestingly enough read that efforts are being made to notify MR. Boasman, by whom? Certainly not the organization.

    I hope that this matter is duly addressed because it makes no sense trying to professionalize the organization (however challenging a job it may be) only to have this become the modus operandi…it is simply not done.
